ModDB announced the winners for Indie Game of the Year earlier today. We didn't make Top 5, however, Both Red Alert: A Path Beyond and Red Alert 2: Apocalypse Rising BOTH made Honorable Mentions! Thank you for your support, we really do appreciate it. Perhaps next year we can do even better!

The reason APB and AR aren't in the top 5 is because they've already been in it. ModDB puts an honorable mention for anyone who would have been in the top five but already has been in the top five of the ModDB awards. Though with a major release of new content (gamma), hopefully we can get in it again this year or the next... (though if i read correctly you may also have to get a higher placing than you did in a previous year...)

To be clear, APB (2nd place, 2007) or Infinity (2nd place, 2008) would have had to place first to get in the top 5, and AR (3rd place, 2008) would have had to place at least second.

AR wouldn't have got it either way as we have not released a significant update in 2009... we have not released anything at all yet. The criteria are to have placed higher than the previous time AND to have had a significant update in 2009, not just to have placed higher.
